TRF-4 denies Lula's defense access to Odebrecht

The TRF-4 (Federal Regional Court of the 4th Region) denied the defense of former president Luiz Inacio Lula da Silva (PT) access to two systems that would have been used by Odebrecht's structured operations sector - in practice, a " tipping department "of the company.

The judges of the 8th Panel confirmed the injunction given by the federal judge João Pedro Gebran Neto in September of this year about the fact.


At the time, Gebran said there was no "blatant illegality" for the request to be complied with. "It is not necessary to speak in violation of the principle of parity of arms because of the limits for access to the material being prosecuted, because, in what matters, access was granted for the performance of expertise," said the judge, reminding that MyWebDay and Drousys are being used in other investigations.

These systems are used by the MPF as evidence in the suit, which Lula's lawyers call "secret evidence."

In order to have access to Drousys and MyWebDay, lawyers appealed to TRF-4 after Judge Sergio Moro of the Federal Justice of Paraná and responsible for Lava Jato proceedings in the lower court, to decide that it was "impracticable to provide a copy of the systems to the defense of Lula or any other ". Last week, the magistrate authorized the examination of Drousys data obtained through a cooperation agreement with Switzerland, but the result of the analysis has not yet been handed to the Justice by the Federal Police.

According to the MPF complaint, the former president received a millionaire kickback in the form of a land for the Lula Institute (which was never used by the entity) and an apartment in São Bernardo do Campo (SP). Lula's defense states that the PT has never owned or owned real estate, let alone against Petrobras' contract negotiations.
