STF resumes trial of the Civil Rights Framework for the Internet under attacks from the right and 'big techs'

The announcement that the STF (Supreme Federal Court) would resume the trial of article 19 of the Civil Rights Framework for the Internet mobilized a campaign on pro-Bolsonaro networks and among platforms, which omitted details of the case to accuse the court of censorship.

The trial is scheduled to resume this Wednesday (4), with the vote of Minister André Mendonça — who had requested a review in December, paralyzing the discussion.

Article 19 states that platforms are not responsible for content published by users of the networks, except if they fail to comply with a court order requiring its removal.

When judging the constitutionality of this article, the court will decide whether networks can be punished if they keep content considered criminal on air — such as images of child sexual abuse, false information about vaccines and scams against consumers, for example. So far, the debate in the court has been divided into two positions:

  • Ministers Dias Toffoli and Luiz Fux defended the repeal of article 19, which would allow platforms to be prosecuted for any type of crime related to third-party content — including so-called “crimes against honor” (insult, slander and defamation);
  • Minister Luís Roberto Barroso proposed considering the provision constitutional, but expanding the list of exceptions to the rule, increasing the liability of companies for a specific list of crimes.

André Mendonça returned the case on the 26th. On the same day, the AGU (Attorney General's Office) filed a  request for a preliminary injunction  requesting the immediate application of parts of Toffoli's vote, in order to anticipate the platforms' liability.

In the request, the agency cited the circulation of scams on Facebook using the INSS (National Institute of Social Security) brand and the death of a girl who inhaled deodorant encouraged by a TikTok challenge.

The movement has put on alert both the platforms — which fear that the increase in duties will affect their profits — and opposition sectors linked to the far right, who are against any type of regulation that could limit their actions in digital media. The mobilization of both groups converged in the accusation that the STF and the government intended to promote “censorship”.

                                                              An attack on a daycare center left four children dead in Blumenau, Santa Catarina, on Wednesday morning (5). The children, aged between 5 and 7, were playing in the playground when a man with an axe invaded the place. Five other children were injured, one of them in serious condition. After the attack, the 25-year-old man walked away and turned himself in to the police.

Four victims who had been injured are now at home with their families; the attack took place on Wednesday (5); the city government announces the implementation of security cameras in all schools and CEIs in the city

Four children who survived the  attack on a daycare center in Blumenau ,  Santa Catarina , were discharged from hospital on Thursday morning (6).

All the children underwent medical examinations and evaluations, according to information from the Santo Antônio Hospital (HSA). During the examinations, the medical team found that one of the patients had a jaw injury, which will be treated on an outpatient basis.

“HSA is grateful for all the support that the community and the press have given the institution at this time. All employees feel that their mission has been accomplished in providing care and support to children and their families,” the hospital said in a statement.
