TSE orders post against Lula to be deleted, and Moraes sees traditional media rent for fake news

                                                   FOLHAPRESS) - The ministers of the TSE (Superior Electoral Court) decided by 4 votes to 3 to exclude from Twitter a video by the producer Brasil Paralelo with criticism of former president Luiz Inácio Lula da Silva (PT).

                                    The ministers considered that the piece causes "informational disorder" by attributing to the presidential candidate cases of corruption that occurred during his term, such as the monthly allowance.

The video that should be deleted had been published on the social network along with the following statement: "Forward this video to those who have no memories of that time - and to those who do, too".




Minister Paulo de Tarso Sanseverino had denied the request by Lula's coalition to delete the video. He acknowledged that there is "negative content" about Lula, but said that the artistic and informative nature of the material published by Brasil Paralelo is "undeniable."
"For this reason, advertising does not transmit information that is seriously decontextualized or supported by facts known to be untrue that go beyond the political debate and the right to criticism", said Sanseverino.




Minister Ricardo Lewandowski opened a disagreement and voted to remove the video. "It attributes a series of corruption scandals that were never judicially imputed to him [Lula]", said Lewandowski.

"I consider the informational disorder presented to be serious", he added.






In the same session, the ministers of the TSE unanimously confirmed the removal of advertisements by Lula that associate President Jair Bolsonaro (PL) with cannibalism.

Twitter must delete the video within 24 hours, under penalty of a fine of R$10,000. The same fine must be applied to Brasil Paralelo, if the producer republishes or shares the piece.

After the TSE decision, Brasil Paralelo published an image of a cake recipe on Twitter, alluding to the way newspapers reacted when they were censored during the military dictatorship.

The presence of one of Brasil Paralelo's partners at an event with Lula came to generate criticism among Bolsonarist influencers. The producer, however, claims to have registered a spike in signatures after this case.

The president of the TSE, Alexandre de Moraes, said that the case exposes "two new forms of disinformation". The first, he said, deals with "handling true premises."

"You put together a lot of true information, which occurred, and then you bring a false conclusion", said Moraes.

The other type of disinformation, according to the president of the TSE, involves the use of traditional media to spread fake news.

"Fraudulent news, or fake news, is not just the primacy of social networks, it also exists in traditional media," said Moraes.

"You cannot accept traditional rental media, media that make supposed journalistic information absolutely fraudulent, to allow this to be replicated and from that disclosure you say, 'no, I'm just replicating what the traditional media put'", he said. still the president of the TSE.




Moraes said that these new forms of disinformation grew in the second round.

The TSE has already determined the removal of at least five contents published by journalistic vehicles since October 1st, the eve of the first round of the Brazilian election.

The list includes an interview with Jovem Pan, a report from the R7 portal and another from O Antagonista, in addition to the reproduction of this by Jovem Pan and a post on the profile of the Gazeta do Povo on Twitter on another topic.

In another case judged this Thursday (13) by the TSE, Moraes again stated that traditional media should be held responsible if they spread fake news.
"We can't think that traditional media only tell the truth. If traditional media also spreads fake news, the legal consequences are the same as social networks. It's not because it's traditional media that it can say whatever it wants," said Moraes.

In this case, the TSE ministers decided to keep the Lulaflix website, created by Bolsonaro's campaign to attack Lula, online, but ordered a video about the "gay kit" to be deleted from the page. Fake news on this topic marked the 2018 presidential election and originated in material to combat homophobia that was made public in 2010, when it was still under analysis by the MEC (Ministry of Education).

The ministers also determined that adjustments be made to the page to make it more explicit that Lulaflix is ​​Bolsonaro's campaign material.
