Moraes approves plea bargain agreement and grants freedom to Mauro Cid, Bolsonaro's former assistant
Minister of the Federal Supreme Court ( STF ) Alexandre de Moraes approved this Saturday (9) the award-winning collaboration agreement of lieutenant colonel Mauro Cid , former aide-de-camp to former president Jair Bolsonaro (PL).
The minister also granted provisional freedom to Cid , subject to precautionary measures, such as the use of an electronic ankle bracelet, restrictions on leaving the house on weekends and at night, and removal from duties in the Army.
The information, anticipated by the blog , was confirmed by the STF in the early afternoon ( see the full note at the end of the report ). At around 2:40 pm this Saturday (9), Mauro Cid left the Brasília Army Battalion, where he had been held since May 3
.
The approval occurs after the collaboration agreement signed with the Federal Police . The complaint refers to the digital militia investigation and all related investigations, such as the investigation into the sale of official gifts received by the Bolsonaro government .
In the investigation into digital militias, the PF investigates the existence of a criminal organization that would have the purpose of attacking the Democratic Rule of Law.
Mauro Cid has been in prison since May 3 , when he was the target of a Federal Police operation investigating the insertion of false vaccination data against Covid , in the Ministry of Health system, of members of the family of the former assistant and the former President Jair Bolsonaro.
Since then, he has also been the target of investigation for his involvement in the alleged irregular sale of official gifts and jewelry received during the Bolsonaro government.
MORAES' DECISION
Minister Alexandre de Moraes ordered the lieutenant colonel to comply with the following precautionary measures:
- use of an electronic ankle bracelet;
- appearance in court within 48 hours, and weekly appearance thereafter, on Mondays;
- ban on leaving the country and delivery of the passport within 5 days;
- cancellation of all passports issued by Brazil in his name;
- suspension of firearm possession, as well as registration certificate for collection, sports shooting and hunting;
- ban on the use of social networks;
- prohibition of speaking to other people being investigated, including through their lawyers. The exceptions are his wife, daughter and father.
Moraes also ordered the lieutenant colonel to be removed from performing his duties as an officer in the Army. In the decision, Moraes states that, in case of non-compliance with precautionary measures, Cid must return to prison.
The minister states that "at the current procedural moment, the closure of numerous investigations by the Federal Police and the hearing of the person being investigated, three times and after his incommunicado status with the other people being investigated was declared, indicate the unnecessary maintenance of preventive detention, as no longer any of the exceptional hypotheses reasonably foreseen in the legislation that allow the relativization of freedom to come and go for the purposes of criminal investigation remains present".
